As a receipient of the American Jurisprudence Award in Copyright Law, I can tell you that the jurisdiction issue isn't necessarily a winner for ff. He will argue that ff committed a tort in the state of Florida by copying his web site, which is most likely run out of the State of Florida. He will attempt to claim jurisdiction via the "committed an intentional act withing the state" doctrine of jurisdiction. I once got jurisdiction in california over a florida web site based upon this doctrine. The real winner for ff is his inability to prove any damages. Ask him for the registration of his copyrighted material. If his material isn't registered by the copyright office before the infringement, then he has to prove the damages he suffered. Ask him to explain his theory of how he was damaged by someone copying his material. Ask him to QUANTIFY IT. My guess is that the traffic to his web site increased and that his aim the whole time was to do that. In fact, he is probably BETTER OFF now that ff posted his material.

I've asked the guy on these threads at least 12 times to explain his theory of damages. The silence is deafening. He has no damages.

By the way, according to his specialties in "administrative law" and "health law," this guy is a total hack that probably got very shitty grades in law school and had to take the bar several times to pass. There's a reason he's working for some solo practitioner in Florida.

If he sues, fight jurisdiction. If he gets jurisdiction, serve him with an interrogatory asking him to state all facts in support of his contention that he suffered damages. The absence of a response will be dispositive on summary judgment. You fuckin' hack Steve H. I would destroy you in court. Go have fun at your "administrative law" hearings arguing lemon law cases in small claims court.

I don't think the case is similiar, Rock. The hurdle he has to overcome is the DMCA which offers safe harbor to Internet and web service providers. Fuckfrance, like AOL, cannot be held responsible for the comments made by members in its forums if we abide by the terms of the DMCA (which we do). I did not post the allegedly infringing material, and we promptly responded to the complaint. Case law would indicate he'd have no luck obtaining jurisdiction in Florida.

I, too, would like to hear his theory on damages and remedy.

I forgot about the safe harbor provisions of the DMCA. You should be fine, although individual posters of infringing material may have problems and can raise the lack of damages as a dispositive issue.

Also, one could argue that he agreed to jurisdiction in Colorado when he signed up and agreed to our Terms of Service. Lawyer that he is, no doubt he read the legalese before agreeing to it. :D
