Former Weather Anchor "golden girl" allegedly fired for military obligations
Nicole Mitchell, former Weather Channel anchor, was hired in part because of her flight experience. She was part of the Weather Channel's highly touted team of professionals who specialize in hurricane coverage. A lot of Mitchell's experience came from her time in the US Air Force Reserve, where she flies aboard a "Hurricane Hunter." From 2004 through 2011, she was well regarded, popular with the audience, and consistently gathered high ratings.
But in 2011, her contract was not renewed. Prior to being laid off, she claims NBC (who purchased the Weather Channel in 2008) began harassing her about her military service.
Now she is suing, claiming that the networks violated her rights under the Uniformed Services Employment Reemployment rights Act of 1994. She alleges that NBC bosses made explicit complaints about her military service schedule and created a “hostile working environment.”
"I was told in an email, ‘Before you agree to military duty, you need to clear it through us first.’ (But) if you don’t show up for orders, you could be court-martialed.”
The key incident came when Mitchell was ordered by NBC executives to appear for a Sunday hair consultation ( No, I'm not making this up).
However, Mitchell, who joined the Air National Guard at age 17, had military duty that weekend, and had given the network advance notice of that duty. Network officials told her that "this is non-negotiable, no excuses" and that the military duty "was not a good answer."
Mitchell performed her military duty and skipped the hair appointment. It wasn’t long before she was transferred from a prime Monday-Friday, 7 AM – 10 AM anchor shift on “Your Weather Today” to a Monday-Friday, 10 PM - 2 AM shift.
Both the Weather Channel and NBC have declined to comment on the case. However, Spokesman David Blumenthal said that "some" of Mitchell's allegations are inaccurate - but refused to provide specifics.

They should be able to fire her (or not renew her contract... that's not really firing somebody) for not showing up to work. She didn't show up to work.
I would have never hired her in the first place. |

This has been law since the 1940s. An employee who has a reserve obligation must be permitted to attend, without exception and without being penalized. It does not matter whether it was ordered, or if the service member volunteered for the duty. Employers cannot refuse to hire someone because they are in the Guard or Reserve, fire them because they are in the Guard or Reserve, or penalize them in any way for membership.
Nonetheless, many employers do. Most know the law and aren't stupid enough to openly say they are doing it because you're a reservist, like NBC here was.
I saw scores of people get out of the Guard on their ETS over the years because they were pressured or threatened by their civilian boss to do so. Some of these employers were major corporations who are quick to wave the flag with Veteran's Day and Memorial Day sales and talk about how they love veterans...or at least the money in their pocket.
TLDR- if NBC fired her because she had a Reserve obligation,they broke a law going back to the 1940s and should have it broke off in their ass. If she'd been going to an Occupy event, I bet they'd have paid her way there. |
